These terms are written in plain English. They cover how you can use this website. They do not replace any signed agreement you have with us.

By using beefymarketing.com (the "Site"), you agree to these Terms and Conditions. If you don't agree, please don't use the Site. "Beefy Marketing," "we," "us," and "our" mean Beefy Marketing, LLC, of Tomball, Texas. "You" means anyone who visits or uses the Site.
These terms work alongside our Security & Privacy policy and our AI Usage Policy. Those pages explain how we handle your information and how we use AI.
2. Using the Site
You may use the Site to learn about Beefy Marketing, read our content, use our free resources, and contact us. You agree not to:
- Use the Site for anything unlawful, fraudulent, or harmful.
- Try to get into parts of the Site, our systems, or our accounts that you aren't authorized to access.
- Disrupt the Site, including by sending malware, overloading it, or getting around security features.
- Scrape, copy, or harvest Site content or contact details in bulk, or use automated tools to do so, except for standard search engine indexing.
- Send spam, fake inquiries, or submissions that pretend to be someone else.

3. Our Content and Intellectual Property
Unless we say otherwise, the Site and its content belong to Beefy Marketing or are used with permission. That includes text, graphics, logos, the Beefy Marketing name and bull mark, photos, videos, audio, downloadable resources, tools, and code. It is protected by copyright, trademark, and other laws.
You may view and share links to our pages, and you may print or save content for your own personal or internal business reference. You may not copy, republish, sell, or create derivative works from our content, or use our name or logos, without our written permission.
4. Portfolio and Case-Study Content
Our Work pages and case studies show projects we've done for clients. Client names, logos, trademarks, and creative work shown there belong to those clients or their respective owners. They appear with permission or as a record of our work. Showing them doesn't mean the client endorses anything beyond the work described, and it doesn't give you any right to use their materials.
Results described in case studies reflect specific clients, timeframes, and circumstances. They are not a promise or prediction of results for any other business.
If you're a client and want something about your project changed or removed, contact us and we'll work with you.
5. What You Send Us
When you submit a contact form, request a quote, or otherwise send us information, you agree that:
- What you send is accurate and is yours to share.
- We may use it to reply to you, scope a potential project, and run our business, as described in our Security & Privacy policy.
- Sending us information doesn't create a client relationship, a contract, or any obligation for either of us.
Please don't send confidential information, trade secrets, passwords, or sensitive personal data through the Site's forms. If a project needs that kind of information, we'll arrange a secure way to share it after we've agreed to work together.
If you send us ideas, feedback, or suggestions about our services or the Site, we may use them without any obligation to you.
6. Quotes, Proposals, and Client Work
The Site describes our services in general terms. Actual project work, including scope, deliverables, timelines, pricing, payment terms, ownership of work product, and confidentiality, is governed only by the signed agreement, proposal, or statement of work (SOW) between Beefy Marketing and that client.
If anything in a signed client agreement or SOW conflicts with these terms, the signed agreement controls for that engagement. These terms don't add to or change any signed client agreement.
7. Prices and Estimates
Prices shown on the Site, including "starting around" figures, typical ranges, and results from our estimator, are general estimates for planning only. They are not offers or quotes. Real pricing depends on scope and is set only in a written quote or signed agreement. We may change published ranges at any time.
8. Wingman Software and Our Promo Store
Wingman, our DIY marketing software, and our promotional products store at promo.beefymarketing.com may have their own terms, policies, and checkout conditions. If you use either one, those specific terms apply to that use, and these terms apply to anything they don't cover.
9. Free Tools and Resources
The Site offers free resources such as checklists, scorecards, generators, and estimators. They are provided for general information and education. They aren't professional, legal, financial, or tax advice, and they don't guarantee any particular result. Use your own judgment and verify anything important before acting on it.
10. Third-Party Links and Services
The Site may link to or include content from other websites and services, such as social media platforms, review sites, payment processors, scheduling tools, or embedded media. We don't control those sites and aren't responsible for their content, policies, or practices. Using them is at your own risk and subject to their terms.

WE DON'T WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY CONTENT IS COMPLETE OR CURRENT.
Marketing results depend on many things outside anyone's control, including search engine and platform changes, competition, and market conditions. Nothing on the Site guarantees rankings, traffic, leads, sales, or any other outcome.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BEEFY MARKETING AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
This section applies to use of the Site only. Liability for client work is governed by the applicable signed agreement. Nothing in these terms limits liability that can't be limited under applicable law.
13. Indemnity
To the fullest extent permitted by law, you agree to indemnify and hold harmless Beefy Marketing and its owners, employees, contractors, and agents from any claims, losses, damages, and expenses, including reasonable attorneys' fees, that arise from your misuse of the Site, your violation of these terms, or your violation of anyone else's rights.
14. Governing Law and Venue
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any legal action arising out of or related to the Site or these terms must be brought in the state or federal courts located in Harris County, Texas, and you consent to the jurisdiction of those courts.
Before filing any claim, please contact us first at info@beefymarketing.com so we can try to resolve it informally.
15. Changes to These Terms
We may update these terms from time to time. When we do, we'll post the new version on this page and update the "Last Updated" date. Changes apply from the date they're posted. If you keep using the Site after that, you accept the updated terms.
16. General
If any part of these terms is found unenforceable, the rest stays in effect. If we don't enforce a provision right away, we haven't waived it. These terms, together with our Security & Privacy policy and AI Usage Policy, are the full agreement between you and us about your use of the Site. They don't replace any signed client agreement.
